Terms and Conditions of C. F. Enterprises
6 night / 7 day Cruise Includes: Accommodations for 6 nights with private stateroom and bath, all meals, alcoholic beverages, and table wines, operating expenses of the barge with full services of the Captain and crew; all side tours and excursions; full use of facilities, including bicycles, games and library; transfers to and from the barge and designated meeting and departure points unless otherwise stated.
11 night / 12 day Cruise Includes: Accommodations for 11 nights with private stateroom and bath, all meals, alcoholic beverages, and table wines, operating expenses of the barge with full services of the Captain and crew; all side tours and excursions; full use of facilities, including bicycles, games and library; transfers to and from the barge and designated meeting and departure points unless otherwise stated.
Cruise Does Not Include: Air transportation and airport taxes; items of personal nature such as gratuities for crew, health and accident insurance, passport, laundry and purchases.
Terms and Conditions for Booking Charters:
- Deposit. A non-refundable cruise deposit of 25% of the cruise cost, together with the completed booking form, is required within two weeks of a telephone reservation to secure charter confirmations.
- Final Payment. A non-refundable full payment of the balance is required at least 90 days prior to the cruise departure day.
- Cancellation. Once initial deposit or final payment is made for a charter, those payments cannot be refunded unless the charter is resold. If a cancelled charter is resold, payments made on the charter up until cancellation will be refunded at the rate the charter is resold, which may be equal to or less than the original cost of the charter.
Cancellations: Notice of cancellations must be made in writing and sent to the booking office of
C. F. Enterprises through the booking agent.
Route Changes: Occasionally a change of route is necessary due to maintenance of canal locks, or other conditions as determined by the captain. While such changes are rare, they should not alter the quality and pleasure of your barging experience.
Cancellation Insurance: We recommend that you consider trip cancellation insurance as a means to prevent hardship and to recover charges in the event of an unexpected cancellation. This coverage is available through your insurance company or travel agent.
GRATUITIES: Gratuities for crew members are entirely discretionary. 5 - 10% of the cruise fare is suggested in the event of total satisfaction with the service on board.
NON-SMOKING POLICY: There is a strict non-smoking policy in the accommodation area of all vessels. In consideration to fellow passengers, those who wish to smoke are requested to do so outdoors, i.e., on the deck and sun-deck area. In accordance with fire prevention regulations, smoking is not permitted in cabins.
PHOTOGRAPHY ON TOUR: C. F. Enterprises reserves the right to take photographs during the cruise operation of any tour or part thereof, and to use the resulting photographs for promotional purposes. By booking a reservation aboard the barge, tour members agree to allow their image to appear in such photographs; tour members who prefer that their image not be used are asked to notify the captain at the beginning of their tour.
Responsibility: C. F. Enterprises and all cooperating agents act only in the capacity of agents in arranging hotels, transportation, sightseeing and any other services listed in the itineraries and as such shall not be held liable for any injury, damage, inconvenience or expense due to any act of default of or action of any hotel, carrier, restaurant or person providing or rendering any of the services associated with the cruise. C. F. Enterprises and their agents cannot be held responsible for any damage, delay or expense due to labor disputes, sickness, war, breakdowns of machinery, weather conditions, accidents or any other misadventures, casualty or any other cause. Furthermore, C. F. Enterprises and their agents accept no responsibility for any injury, death, expense, damage to, or loss of, personal property, including theft of luggage or valuables, which may be sustained on account of or by reason of any defect in any vehicle, bicycle, boat or common carrier, or of any act or omission to act by any persons or company providing such services. Any such losses or expenses will have to be borne by the passengers.
C. F. Enterprises reserves the right to withdraw or cancel any cruise prior to departure and to change itinerary or cruise route should circumstances require it. The right is also reserved to decline to accept or retain any person as a passenger should such person's health or general deportment impede the normal operation of the cruise. In such cases, refunds will be based on the cost of the unfinished portion of the cruise. Changes in route because of local conditions are at the discretion of the captain, and cannot be a basis for cancellation or refund. Some waterways may be subject to occasional closures due to drought, storms, floods, canal or lock repairs or other unforeseen circumstances that result in conditions unsafe for navigation. In the unlikely event of such occurrences, if navigation must be suspended, passengers will continue to be accommodated on the stationary vessel and the regular excursions will continue to be made, with cruising to be continued as soon as possible. By way of compensation for any absence of cruising, additional excursions will be provided by the vessel's crew.
You understand and acknowledge by your signature on the booking form that you have read and agree to the terms and conditions stated above, and that C. F. Enterprises and booking agents assume no liability whatsoever for, or with respect to (a) the rendition or non-rendition of services by C. F. Enterprises or by any vendor engaged by C. F. Enterprises, or (b) any injury or loss resulting from such rendition or non-rendition. This agreement between you and C. F. Enterprises is the sole contract regarding the cruise you are booking on the booking form.
Release: Each cruise participant (including any person designated in any booking, whether named or not) declares that he is of good general health. Each such cruise participant, in consideration of C. F. Enterprises or its agent booking him on a cruise and the common carriers or providers of transportation or other services by contract or otherwise, with, through, or for C. F. Enterprises (collectively, the "Contractors") or their agents accepting him on that cruise, on behalf of himself and his heirs, legal representatives, executors and assigns, hereby releases C. F. Enterprises, the Contractors, and their respective agents from, and agrees to indemnify and hold each of them harmless against any and all liabilities, costs and expenses (including attorney's fees and costs of litigation) which they may jointly or severally incur to such participant, his heirs, legal representatives and assigns, in respect of any claim, suit or cause of action on account of any injury, or damage to or in respect of person or property alleged to have been sustained by him, directly or indirectly, as a result of his participation in the cruise, including without limitation any such injury or damage in connection with (i) any transportation, accommodation or other services; (ii) any loss caused by any act or omission of any employee, servant or agent of any of them providing goods or services to any cruise participant and (iii) any additional expenses or other damages sustained by any cruise participant as a result of the foregoing causes. Any release from liability for injury or damages given to C.F. Enterprises and all cooperating agents shall not apply in the event such injury or damage is due to the negligence of C.F. Enterprises or its cooperating agents.
